Terms of Service

1. Description of Service

etFrame is a structural engineering calculation and modelling service provided by etFrame (hereinafter “the service provider”). By using the service, you agree to these terms.

2. Age Requirement

Use of the service requires a minimum age of 16 years. By registering, you confirm that you are at least 16 years old.

3. User Accounts

You may register using an email address or a Google account. You are responsible for the accuracy of your account information and for maintaining the security of your account. Report any suspicious activity to the service provider immediately.

4. License Tiers

The service is available at the following levels:

  • Guest access — limited access to basic features without the ability to save work.
  • Free account — registered users gain access to basic features and limited cloud storage.
  • Academic license — available to educational institutions that have entered into an agreement with the service provider. The license is tied to the institution’s email domain and requires periodic re-verification. The license remains valid until the agreement expires.

The service provider reserves the right to change the content and restrictions of license tiers. Changes may affect existing accounts, including the availability of cloud-stored models.

5. User Content and Model Ownership

Calculations and models created in the service are the property of the user. The user grants the service provider the right to use models for service development, testing, and quality assurance. Models will not be shared with third parties without the user’s consent.

The service provider reserves the right to remove models stored in the service if the terms of service or license tier change. The service provider will endeavour to notify users of material changes, but is not obligated to retain models following changes to the terms of service.

6. Use of the Service and User Responsibility

You shall be solely responsible for your use of the service, including but not limited to any calculations, prints and output resulting thereof, input data and any errors therein, and data file backups and maintenance.

You agree to use the service only for its intended purpose and to use the latest available version of the service at all times. The service provider reserves the right to restrict or suspend access to the service if you breach these terms.

Use of the service does not eliminate the need for an expert review of the design by a qualified engineer or designer. You are solely responsible for applying the results of the service in practice and for all structural design decisions. Any output from the service must be thoroughly checked prior to implementation.

The service is provided to you entirely for use at your own risk. Although the service provider uses commercially reasonable efforts to control and update the service and to verify that it calculates in accordance with the applicable design standards, their national annexes, and National Non-Contradictory Complementary Information (NCCI) documents, the service provider does not warrant that it does so without error.

You may not use the service for any mission-critical or real-time application. It is an express requirement of these terms that any output from the service is thoroughly checked prior to implementation and that the use of the service does not eliminate the need for an expert review and control of the design by a qualified engineer. You accept responsibility to verify that the service meets your specific requirements.

7. Disclaimer of Warranties

The service is provided on an “as is” basis without any warranty or representation of any kind. The service provider disclaims any and all representations and warranties, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose or general use (including your particular business or intended use), hardware or software compatibility, or of the service’s reliability, performance, security, or continued availability.

The service provider does not represent or warrant that the service or any calculations, prints, or export data made thereof will be free from viruses, malware, trojan horses, or any other defects or errors, that any such defects or errors will be corrected, or that the service will operate without interruption. You are solely responsible for all costs and expenses associated with rectification, repair, or damage caused by such defects, errors, or interruptions.

The service provider does not represent or warrant that the service does not infringe the intellectual property rights of any other person. You accept responsibility to verify that the service meets your specific requirements.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the service provider be liable to you or any third party, under any theory of liability whatsoever (including but not limited to negligence and strict liability) and whether in an action in contract, tort, product liability, statute, or otherwise, for any direct or indirect, incidental, consequential, special, punitive, or exemplary damages, or for any lost revenue, lost profits, or expected benefit not achieved, relating to the service or your use thereof, or your inability to use the service, whether or not foreseeable and whether or not the service provider has been advised of, knew, or should have known of the possibility of such loss or damage.

Without limiting the foregoing, the service provider shall have no liability for:

  • loss of data or other loss relating to the service or its use;
  • the interpretation of design standards, their national annexes, or National Non-Contradictory Complementary Information (NCCI) documents;
  • the interpretation of type approvals or certificates of products included in the service;
  • the accuracy or reliability of calculations or output produced by the service;
  • data exported from the service to third-party applications.

The service provider has no obligation to verify, correct, complete, or update the service, and you shall have no right to seek any remedy for any defect, error, or failure of the service.

Nothing in these terms shall exclude or limit either party’s liability for death or personal injury caused by negligence or for fraudulent misrepresentation. The limitations of liability are valid to the extent permitted by applicable mandatory law.

You acknowledge that the disclaimers of warranties and the limitations on liability set out in these terms are material provisions of the agreement between you and the service provider, that they are reflected in the fee (if any) charged for the service, and that the service provider would not make the service available to you if these disclaimers and limitations were deleted or modified to be more favourable to you.

By accepting these terms, you acknowledge that you have read, understood, and agreed to the disclaimers of warranties and the limitations on liability set out above.

9. Indemnification

You shall indemnify and hold harmless the service provider and its representatives from and against any damages, losses, or expenses (including legal fees) incurred in connection with any third-party claims arising out of or resulting from your use of the service.

10. Personal Data Processing

The service collects and processes the following personal data:

  • Name and email address upon registration
  • Login information and session data (device, login timestamp)
  • Service usage data for service improvement
  • Academic license verification data

All data is stored within the European Union. Processing is based on the service agreement (GDPR Article 6(1)(b)) and the service provider’s legitimate interest in improving the service (GDPR Article 6(1)(f)).

Users have the right to download their data and request account deletion through the account settings. Data will be permanently deleted within 30 days of a deletion request.

11. Third Parties

The service provider does not share users’ personal data with third parties, except where required by law.

Google Sign-In is subject to Google’s Terms of Service and Privacy Policy. Google shares the user’s name and email address with etFrame during sign-in, which are used solely for the purpose of creating a user account.

12. Service Availability

The service provider aims to keep the service continuously available but does not guarantee uninterrupted operation. The service provider reserves the right to suspend the service for maintenance or development purposes.

13. Changes to Terms

The service provider reserves the right to modify these terms without prior notice. By continuing to use the service, you accept the updated terms. The current terms are always available at etframe.com/terms.

14. Governing Law

These terms are governed by Finnish law. Any disputes shall primarily be resolved through negotiation. If no settlement is reached, disputes shall be resolved in the Satakunta District Court.
